Welcome to NurseMe. These Terms of Service ("Terms") govern your access to and use of NurseMe's website, applications, and services.
1. Acceptance of These Terms
By creating an account, booking services, or otherwise using NurseMe, you agree to these Terms and our Privacy Policy.
If you do not agree, do not use NurseMe.
2. Eligibility
You may use NurseMe only if you:
- Are at least 18 years old.
- Have the legal capacity to enter into this agreement.
- Book services for yourself.
- Provide accurate and complete information.
3. Your Account
You are responsible for maintaining the security of your account and for all activity that occurs under it.
You must promptly update any information that becomes inaccurate or outdated.
You may not share your account or allow another person to use it.
4. NurseMe Services
NurseMe connects clients with qualified licensed nurses for services offered through the platform.
The services currently offered through NurseMe are described on the platform and may change over time.
NurseMe is not an emergency service. Call 911 immediately during a medical emergency or whenever immediate assistance is required.
5. Booking Services
Submitting a booking request does not guarantee that a nurse will be assigned.
A booking is confirmed only after NurseMe successfully matches and schedules a qualified nurse.
When reasonably necessary, NurseMe may assign another qualified nurse to fulfill a confirmed booking.
Service availability depends on nurse availability and operational requirements.
6. Payments
Prices shown at checkout control.
Payment is collected in full before scheduled services begin.
Applicable taxes and fees, if any, will be displayed during checkout.
NurseMe currently provides private-pay services only.
7. Cancellations and Refunds
Cancellation and refund terms are set out in your Client Agreement.
8. Acceptable Use
You agree not to:
- Provide false or misleading information.
- Interfere with the operation or security of NurseMe.
- Use NurseMe for any unlawful purpose.
- Request services outside a nurse's lawful scope of practice.
- Harass, threaten, discriminate against, or abuse NurseMe personnel.
- Attempt to bypass the platform to avoid applicable fees or contractual obligations.
NurseMe may suspend or terminate your account if you violate these Terms.
9. Relationship of the Parties
These Terms govern the relationship between you and NurseMe.
Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship between you and any individual nurse.
10. Intellectual Property
The NurseMe platform, including its software, branding, trademarks, graphics, and content, is owned by NurseMe or its licensors and is protected by applicable intellectual property laws.
You may not copy, modify, distribute, reverse engineer, or create derivative works except as permitted by law or with NurseMe's written permission.
11. Disclaimers and Limitation of Liability
Nothing on the NurseMe platform constitutes medical advice, diagnosis, or treatment.
NurseMe does not guarantee that services will always be available at a requested date or time.
Except as required by law, NurseMe makes no warranties regarding uninterrupted availability of the platform.
To the fullest extent permitted by law, NurseMe is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the platform or services.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
12. Changes and Termination
NurseMe may update these Terms from time to time.
Material changes become effective upon publication unless otherwise stated. Continued use of NurseMe after the effective date constitutes acceptance of the revised Terms.
NurseMe may suspend or terminate your account if you violate these Terms or if continued access would create legal, operational, or safety concerns.
13. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles.
Any dispute arising out of or relating to these Terms or your use of NurseMe will be brought exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of those courts.
